How regularisation works
From time to time the state government regularises colonies that grew without approval. Residents pay the government's charges and receive pattas. In March 2025, for example, the Urban Development and Housing department decided to regularise 87 such colonies in Jaipur, mostly in Sanganer. The Rajasthan Housing Board was to transfer the plots to JDA, which would hold camps to issue pattas.
Regularisation has limits. In 2022 the Rajasthan High Court upheld the government's power to regularise agricultural land that was used for housing without permission, under Section 90-B (as it then stood) and Section 90-A. It also held that uses conflicting with the master plan, such as parks, roads and water bodies, cannot simply be regularised. A society patta plot inside a planned road or park may never get a JDA patta.
What “90-B approved” means
Section 90-B was the earlier provision of the Rajasthan Land Revenue Act under which unauthorised conversions of agricultural land were regularised. Today conversions are made under Section 90-A. If a seller calls a plot “90-B approved”, ask for the actual order and check whether a JDA patta has since been issued for the plot. The label alone does not tell you the plot is in an approved layout.
What makes a plot “loanable”
Banks call a plot loanable when its papers satisfy them: an approved layout, a valid patta in the seller's name, a clean title chain and no encumbrance. Every lender has its own list, so share the documents with your bank before you pay a booking amount.
Which should you buy?
- If you need a loan or plan to build soon, buy a JDA patta plot. See how to check a JDA approved plot.
- If a society patta plot is much cheaper, find out whether its colony is already listed for regularisation, what the charges would be, and whether the plot falls in a road, park or ecological zone on the master plan.
- Either way, compare the price with the area rate and run the due diligence checklist.
